Welcome to LoamviewPark Photography. These Terms and Conditions ("Terms") govern your use of our website at loamviewpark.xyz (the "Website") and our photography services (the "Services"). Please read these Terms carefully before accessing or using our Website or Services.

By accessing or using the Website or engaging our Services, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Website or use our Services.

1. Photography Services

1.1 Service Description

LoamviewPark Photography provides professional photography services including but not limited to portrait photography, event photography, commercial photography, and other photography services as agreed upon in writing between LoamviewPark Photography and the client.

1.2 Booking and Confirmation

All photography services must be booked in advance. A booking is confirmed only upon:

1. Receipt of a signed contract (either electronically or in print)
2. Payment of the required deposit or retainer fee

Until both of these conditions are met, we reserve the right to book other clients for the same date and time.

1.3 Deposits and Payment

A non-refundable deposit (typically 25-50% of the total fee) is required to secure a booking. The specific amount will be stated in your contract. The remaining balance is due according to the payment schedule outlined in your contract. For most services, full payment is required before or on the day of the photography session.

1.4 Rescheduling

Requests to reschedule must be made in writing at least 14 days before the scheduled session date. Rescheduling is subject to our availability. Rescheduling with less than 14 days' notice may result in additional fees or forfeiture of your deposit, as detailed in your contract.

2. Cancellation Policy

2.1 Client Cancellation

If you need to cancel your photography session, the following terms apply:

• Cancellation more than 30 days before the session: The deposit is non-refundable, but any additional payments made will be refunded.
• Cancellation 15-30 days before the session: 50% of the total session fee is due.
• Cancellation less than 15 days before the session: The full session fee is due.

All cancellations must be made in writing.

2.2 Photographer Cancellation

In the unlikely event that LoamviewPark Photography must cancel a session due to illness, emergency, or other circumstances beyond our control, we will:

1. Attempt to find a qualified replacement photographer, or
2. Reschedule the session at a mutually convenient time, or
3. Refund all payments made, including the deposit

Our liability is limited to the return of all payments made for the session in question.

3. Image Delivery and Usage Rights

3.1 Delivery Timeline

The timeline for delivery of final images will be specified in your contract. Typical delivery times range from 2-6 weeks depending on the service. These timeframes are estimates and may be extended during peak season or in exceptional circumstances.

3.2 Image Editing

All images are professionally edited according to our standard style. This includes color correction, exposure adjustment, and basic retouching. Extensive retouching (skin smoothing, body contouring, object removal, etc.) is available at an additional charge unless specified in your package.

3.3 Image Selection

We reserve the right to determine which images to deliver based on our professional judgment. The number of images delivered will be as specified in your contract. We do not provide RAW files or unedited images under any circumstances.

3.4 Client Usage Rights

Upon full payment, clients are granted a non-exclusive license to use the delivered images for personal use, including printing, sharing on social media, and displaying in their home or office. Commercial use requires additional licensing and fees unless specifically included in your contract.

3.5 Photographer's Rights

LoamviewPark Photography retains copyright ownership of all images created. We reserve the right to use the images for promotional purposes, including but not limited to our portfolio, social media, blog, advertising, contests, and print displays. If you require privacy or have concerns about image usage, please discuss this with us before signing the contract.

3.6 Image Archiving

We will store your edited images for a minimum of one year after delivery. While we maintain backup systems, we strongly recommend that clients download and backup their images promptly after delivery. Additional fees may apply for retrieval of images after the archival period.

4. Client Responsibilities

4.1 Cooperation

The client agrees to cooperate and communicate with the photographer regarding plans, schedules, and expectations. The client is responsible for securing access to requested shooting locations and obtaining any necessary permissions or permits for photography at the chosen locations.

4.2 Punctuality

The client agrees to be ready at the scheduled time. Delays caused by the client may result in reduced shooting time or additional fees. For event photography, a detailed timeline should be provided at least one week in advance.

4.3 Safe Working Environment

The client is responsible for ensuring a safe environment for the photographer to work in. The photographer reserves the right to terminate coverage without refund if the photographer experiences inappropriate, threatening, hostile, or offensive behavior from anyone at the photography session.

5. Website Terms of Use

5.1 Intellectual Property

The Website and its original content, features, and functionality are owned by LoamviewPark Photography and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

5.2 User Conduct

While using our Website, you agree not to:

• Use the Website in any way that violates any applicable local, state, national, or international law or regulation
• Impersonate or attempt to impersonate LoamviewPark Photography, a LoamviewPark Photography employee, another user, or any other person or entity
• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Website
• Use the Website to advertise or offer to sell goods and services
• Engage in unauthorized framing of or linking to the Website
• Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Website
• Use any robot, spider, or other automatic device to access the Website for any purpose

5.3 User Content

If you submit any content to our Website (such as comments or testimonials), you grant us a non-exclusive, royalty-free license to use, reproduce, modify, publish, and display such content on our Website and in our promotional materials.

6. Limitation of Liability

6.1 Photography Services

While we take the utmost care in providing our Services, LoamviewPark Photography's maximum liability for any claim arising from the provision of our Services is limited to the amount paid for the Services. We are not liable for:

• Missed images or opportunities due to conditions beyond our control
• Loss of images due to technical failure beyond our reasonable control
• Disappointment with the creative results of the images
• Delays in delivery due to circumstances beyond our control

6.2 Website Use

The Website and its contents are provided on an "as is" and "as available" basis. LoamviewPark Photography makes no warranties, expressed or implied, regarding the operation or availability of the Website. In no event shall LoamviewPark Photography be liable for any indirect, incidental, special, consequential or punitive damages resulting from the use of or inability to use the Website.

7. Indemnification

You agree to defend, indemnify, and hold harmless LoamviewPark Photography, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Website or Services.

8. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom. Any dispute arising under these Terms shall be resolved exclusively by the courts located in the United Kingdom.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any changes by updating the "Last Updated" date at the top of these Terms. Your continued use of the Website or Services after any such changes constitutes your acceptance of the new Terms.

10. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
